Terms of Service
Nexus Platform — seven connected packages, one login
1Acceptance of Terms
By accessing the Nexus Platform ('Platform') operated by Nexus Technology, you agree to these Terms. This Platform is deployed exclusively for authorised personnel of Shanagan Coal Mine, Dundgovi Province, Mongolia.
Unauthorised access is strictly prohibited and may be subject to legal action under Mongolian law.
2Service Description
The Platform is licensed as seven connected packages: Enterprise (tasks, HR, inventory, procurement, finance, legal), Mining (camera surveillance with AI detection, fleet and asset GPS tracking, PPE compliance monitoring, weighbridge, digital twin, HSE), Engineering (drafting, geological modelling, drone-survey computation), Customs (export declarations), Security (gates, visitors, incidents, patrols), Logistics (dispatch, trip tracking, contractor settlement) and Control (tenant and platform administration). A customer may license any subset.
Service availability depends on local network infrastructure and power supply at the mine site.
3Access & Accounts
Account creation requires approval by a system administrator or mine supervisor. You are responsible for maintaining the confidentiality of your credentials and must report any suspected unauthorised access immediately.
Accounts are assigned role-based permissions. You must not attempt to access resources beyond your assigned permission level. All access is logged for security purposes.
4Camera Surveillance Disclosure
This Platform operates a multi-camera surveillance system covering the Shanagan Coal Mine site. All personnel on site are subject to continuous video recording, disclosed through on-site signage and this notice. Footage and any personal data derived from it are processed under the Law of Mongolia on Personal Data Protection (effective 1 May 2022) for legitimate mine safety, security and operational purposes only. Footage is retained for 7 days on local edge storage and may be retained longer for incident investigation.
AI-based YOLO detection analyses camera feeds in real time to identify persons, vehicles, equipment, and PPE compliance. Person and facial imagery may constitute sensitive personal data under Mongolian law; it is processed solely for on-site safety and access control and is not disclosed externally except as permitted by law or with the data subject's consent. Detection events (bounding boxes, confidence scores, timestamps) are stored on the on-site system database.
5Acceptable Use
You agree to use this Platform solely for legitimate mine operations. Prohibited: unauthorised data export, credential sharing, bypassing security controls, interfering with AI detection systems, or monitoring individuals for non-operational purposes.
Tampering with camera hardware, GPS devices, or edge servers is strictly prohibited and will result in immediate account termination and potential criminal referral.
6Data Handling & Retention
The Platform collects and stores: user profile data, worker GPS location pings, camera detection events, footage segments (HLS/TS files), system health metrics, alert history, and procurement records. Personal data is collected and processed on the legal bases set out in the Law of Mongolia on Personal Data Protection.
Camera footage: 7-day rolling retention with automatic deletion. Detection records: stored on on-site edge servers. Alerts and operational data: retained on Supabase cloud infrastructure, which may process data outside Mongolia — any such cross-border transfer is carried out only on a legal basis permitted by the Law on Personal Data Protection. Location pings: purged automatically after 30 days. You may request access to, correction of, or deletion of your personal data through your administrator.
7Third-Party Services
This Platform uses: Supabase (authentication and cloud database — supabase.com), OpenWeather API (weather data — openweathermap.org), Ultralytics YOLO (AI object detection model for camera analysis).
Authentication is subject to Supabase's Terms of Service. Weather data is informational only. YOLO detection results are probabilistic and should not be the sole basis for safety decisions.
8Limitation of Liability
Nexus Technology provides this Platform 'as is' for internal mine operations. We do not warrant uninterrupted or error-free service. The Platform is not a substitute for direct human supervision or physical safety equipment.
AI detection results, including PPE alerts, are supplementary monitoring tools. Nexus Technology is not liable for incidents arising from reliance on automated detection in place of direct supervision.
9Termination
Access may be terminated immediately by administrators for: violation of these terms, end of employment or contractor relationship, security breach, or operational requirements.
Footage and detection records pertaining to terminated users may be retained for the standard 7-day period; incident records may be retained indefinitely.
10Governing Law
These Terms are governed by the laws of Mongolia — including the Law on Personal Data Protection (2021, effective 1 May 2022), the Law on Cyber Security (2021), the Minerals Law of Mongolia, and applicable labour and occupational health & safety legislation. Any dispute is subject to the exclusive jurisdiction of the courts of Mongolia.
For questions about these Terms or your personal data, contact the mine supervisor or system administrator at info@nexus-technology.mn. In Mongolia, data-protection oversight is exercised by the National Human Rights Commission and the Ministry of Digital Development and Communications.
